1. By the present writ petition, the petitioner is seeking a direction towards the respondent No.2/Collector, Janjgir-Champa to decide the pending stay application filed by him and further he is questioning the order dated 05/11/2024 by which an order of recovery and removal of the petitioner from the Office of Sarpanch, Gram Panchayat, Podidalha has been passed by the SDO (Revenue), Janjgir-Champa.

Learned counsel appearing for the petitioner by referring order sheets dated 08/11/2024 and 11/11/2024 passed by the Collector, submits that the Collector has heard the matter of appeal but there is no order has been passed by him on the stay application.

Learned counsel appearing for the respondents/ State does not oppose the submission made by the learned counsel for the
3 / 3 petitioner and would submit that though the hearing is concluded, no order has been passed on the stay application filed by the petitioner.
4. I have heard learned counsel for the parties and perused the documents.
5. Looking to the submission made by the learned counsel for the petitioner that the Collector, Janjgir-Champa has not passed any
order on the stay application filed by the petitioner, it is directed that the Collector, Janjgir-Champa shall hear the application for grant of stay and pass an order within a period of five days from the date of receipt of a copy of this order.
6. With the aforesaid direction, this writ petition is disposed of.
