For Respondent : Mr. Vivek Chaudhary, PP with Mr. Shubham Sain, AAAG HON'BLE MR. JUSTICE ASHUTOSH KUMAR Order 16/12/2025 1. As all these bail applications have been filed against the order of dismissal of bail applications of the present accused-applicants pertaining to the same FIR, they are being heard and decided by the instant common order. 2. The present bail applications have been filed by the accused- applicants under Section 483 of the B.N.S.S, 2023 in the matter arising out of FIR No.338/2025 registered at Police Station Jurhera, District Deeg for the offences punishable under Sections 319(2), 318(4), 338, 336(3), 340(2), 317(5), 303(2), 308(2), 313 and 61(2)(a) of B.N.S., 2023 and Section 66-D of Information Technology (Amendment) Act, 2008 (hereinafter referred to as the 'Act of 2008'). 3. Learned counsel for the accused-applicants submits that the accused-applicants have falsely been implicated in this case. Learned counsel for the accused-applicants also submits that the allegation against the accused-applicants is that they used stolen mobile phones, fake SIM cards and fake IDs on social media sites for the purpose of defrauding the innocent people by promising them to purchase Sarees, Salwar-Kameez etc. at discounted rates while using fake bank accounts for such transactions, however, [2025:RJ-JP:50746] (3 of 4) [CRLMB-15559/2025] there is no evidence on record to prove the same and also, no amount has been received by the accused-applicants in any fraudulent manner. Learned counsel contends that there is no complaint lodged by private person against the accused-applicants and the present FIR has been lodged by the Police Authorities. Learned counsel further contends that the charge-sheet has been filed and trial will take long time to conclude. 4. Learned counsel for the accused-applicant argues that the present accused-applicants were arrested on 08.11.2025 and since then, they are behind the bars, therefore, the accused- applicants be enlarged on bail. 5. On the other hand, learned Public Prosecutor opposes these bail applications. 6. Heard learned counsel for the parties and also perused the material available on record. 7. Considering the overall facts and circumstances of the case and the period of custody of the accused-applicants; that the charge-sheet has already been filed and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow these bail applications filed by the accused-applicants. 8. Consequently, these bail applications filed under Section 483 of the B.N.S.S., 2023 are allowed. It is ordered that the accused-applicants namely; (1) Aakil S/o Jakar, (2) Yunus S/o Kallu, (3) Asgar S/o Israil, (4) Mohabbat S/o Mubeen, (5) Aakil S/o Sahab Khan & (6) Rasid S/o Isav, arrested in FIR No.338/2025 registered at Police Station Jurhera, District [2025:RJ-JP:50746] (4 of 4) [CRLMB-15559/2025] Deeg shall be released on bail; provided each of them furnishes personal bond in the sum of Rs.1,00,000/- each and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court. Applicants will be required to appear before that Court on all dates of hearing and as and when called upon to do so. 9. The accused-applicants are also directed to mark their presence in third week of every month till conclusion of trial before the concerned Police Station. SHO of the concerned Police Station shall send the presence report of the accused-applicants to learned trial Court every month. In case of any breach to the above condition, learned counsel for the State shall be free to move the application against the accused-applicants for cancellation of bail before concerned Magistrate. 10.
