DOSHI Date : 03/09/2025 ORAL ORDER The petitioner had earlier preferred Criminal Misc. Application No.12257 of 2013 under Section 482 of the Code of Criminal Procedure, 1973, seeking quashment of the impugned FIR. However, the said application came to be withdrawn vide order dated 31.07.2013. It is further pointed out that, despite the lapse of considerable time, the investigation qua the present petitioner has not culminated into the filing of a chargesheet. In view of the aforesaid, learned advocate Mr. Chetan K. Pandya, appearing for the petitioner, seeks permission to withdraw the present petition with liberty to initiate appropriate proceedings, including by way of a fresh petition before this Court, in the eventuality that the petitioner is chargesheeted. Permission, as prayed for, is granted. The present petition accordingly stands disposed of as withdrawn. It is clarified that in the event of a chargesheet being filed against the petitioner, he shall R/CR.MA/1736/2014 ORDER DATED: 03/09/2025 be at liberty to avail of appropriate remedies in law, including approaching this Court. Needless to observe, this Court has not entered into the merits of the case, and all contentions are kept open. Rule/Notice, if any, stands discharged. Interim relief, if any, shall stand vacated.
