GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondent No.2 in completing the investigation in Crime No.71 of 2021 registered for the offences punishable under Sections 166,167, 385, 409, 418, 419, 420, 423, 426, 464, 471, 477, 120-B R/w 34 IPC and filing the Charge Sheet as is provided under Section 173 of the Code of Criminal Procedure as arbitrary, illegal, abdication of the statutory duty cost on him and violative of the fundamental rights guaranteed to the petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.2 to complete the investigation in Crime No.71 of 2021 registered for the offence under Sections 166, 167, 385, 409, 418, 419, 420, 423, 426, 464, 471, 477, 120-B r/w 34 IPC and file charge sheet as is provided under Section 173 of the Code of Criminal Procedure, 1973.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on instructions, would submit that the police have completed the investigation in this matter and the case is referred as civil in nature. 3. Recording the said submission, the Writ Petition is disposed of. However, the petitioner is at liberty to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
