1. The petitoner has preferred this petition for issuance of necessary directions to the official-respondents to provide adequate security and protection to him on the ground that he
(2 of 3) [CRLW-1186/2025] is facing threats to his life and liberty at the hands of private respondents. 2. Counsel for the petitioner submits that for the incident dated 11.08.2025, a report was registered with Police Station Jawahar Nagar, District Jaipur City East on 11.08.2025 for the offences under Sections 115(2), 126(2), 308(2), 140(3), 305(a), 351(2) and 3(5) of the BNS, 2023. Counsel submits that after registration of the aforesaid FIR, the private respondents have threatened the petitioner for the dire consequences by lodging the aforesaid FIR, for which two different complaints were submitted by the petitioner before the authority. Counsel submits that the authorities are not paying any head in the matter and threat upon the petitioner is still continuing. Counsel submits that before approaching this Court, the petitioner has submitted a representation before the Nodal Officer/Commissioner of Police, Jaipur on 13.08.2025 pursuant to the orders passed by the Co-ordinate Bench of this Court in the case of Suman Meena vs. State of Rajasthan (S.B. Criminal Writ Petition No.792/2024), but no orders have been passed in favour of the petitioner, hence, interference of this Court is warranted. 3.
Per contra, Public Prosecutor opposed the prayer and submitted that in the original FIR No.209/2025, the petitioner submitted an application to the Investigating Officer that he does not want to prosecute the accused person of the said FIR. Counsel submits that the petitioner and the accused were friends, but some dispute arose between them subsequently. (3 of 3) [CRLW-1186/2025] He submits that so far as other two complaints lodged by the petitioner are concerned, the complaints have been registered with different Police Stations and the matter is still under investigation, hence, under these circumstances, interference of this Court is warranted. 4. It is well settled legal proposition of law that life and personal liberty of the individuals has to be protected except according to procedure established by law, as mandated by Article 21 of the Constitution of India. 5. Considering the arguments put forward by the rival sides and looking to the fact that before approaching this Court, the petitioner
has
already
submitted
appropriate representation/application seeking protection before the Nodal Officer/Commissioner of Police, it is expected from the officers concerned to look into the matter in terms of the directions issued by this Court in the case of Suman Meena (supra) and ensure that after analyzing the threat perceptions, if necessitated, may pass necessary orders to provide adequate security and protection to the petitioner. 6. Before parting with this order, it is made clear that any observation made by this Court or the Nodal Officer would not affact any criminal/civil proceeding initiated against the parties. 7. With the aforesaid observations, the instant criminal writ petition stands disposed of. The stay application and all pending applications, if any, also stand disposed of. (ANOOP KUMAR DHAND),J KuD/11
