Judgment 19/11/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 0204/2023 registered at Police Station Harnavadashahaji District Baran for the offence(s) under Sections 394, 302 of BNS, 2023.
2.
Learned counsel for the accused-applicant has submitted that the applicant is aged about 37 years. It is further submitted that the applicant has been in custody since 29.12.2023, the challan has been filed and the trial is likely to take considerable time to conclude. It is further submitted that although six criminal antecedents are reflected against the applicant, he has been exonerated in two of them and has filed compounding in the remaining cases. It is also submitted that co-accused Ramvilas,
[2025:RJ-JP:46608] (2 of 2) [CRLMB-1347/2025] who was specifically attributed the cause of death and from whom no recovery had been made, has already been granted bail by the learned Trial Court.
3. Per contra, learned Public Prosecutor has opposed the instant bail application and submitted that the case of the co-accused stands on a different footing, as he was enlarged on bail by the learned Trial Court on account of being in the last stage of cancer, and further, no recovery of the knife was made from him. It is further submitted that the cause of death was the injuries inflicted on the neck and ear by a sharp weapon, and the offence is heinous in nature.
4. Considering the arguments advanced by the counsel for the parties, considering that the applicant has six criminal antecedents against him; that the allegations leveled herein are of heinous nature and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is not inclined to allow the bail application of the accused-applicant.
5. Accordingly, the bail application under Section 483 BNSS is dismissed at this stage.
