The agreement of fair price shop of the petitioner was cancelled by the respondent No.2/District Supply Officer, Varanasi vide order dated 16.12.2024. Aggrieved with the aforesaid orders, the petitioner has preferred the present petition. 2. Today when the matter is taken up, a preliminary objection has been raised by learned Standing Counsel that against the aforesaid order, a statutory alternative remedy is available to the petitioner to file appeal before the Appellate Authority as provided under Section 13(1) of the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order 2016. 3. At this stage, a prayer has been made by learned counsel for the petitioner to dismiss the present petition as withdrawn with liberty to file statutory appeal before the Appellate Authority. 4. Accordingly, the present petition is dismissed as withdrawn with liberty as prayed. 5. It is made clear that in case, the petitioner will file appeal before the Appellate Authority as provided under Section 13(1) of the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order 2016 within a period of two weeks from today along with a certified copy of this order, the Appellate Authority will decide the same strictly in accordance with law expeditiously strictly in accordance with law but without granting any unnecessary adjournment, if there is no legal impediment.
