Neutral Citation No. - 2025:AHC:63634-DB Court No. - 29 Case :- WRIT - C No. - 12534 of 2025 Petitioner :- Prakash Giri Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Mahesh Kumar Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J. This petition has been filed alleging that petitioner is a senior citizen and that he is being harassed by the respondents. Reliance is placed upon Rule 21 of the Rules framed under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 to state that the life and property of a senior citizen is liable to be protected. The petition is opposed by learned State Counsel, who points out that there is a serious civil dispute and the petitioner virtually wants cancellation of a sale deed executed in the year 2010, which would be beyond the scope of powers of the authorities under the Senior Citizen Act. The petitioner claims that he is 61 year old. He alleges that the sale deed executed by his Aunt in the year 2010 is invalid because she has already died in the year 1983. The nature of dispute raised by the petitioner is with regard to deed of transfer executed in the year 2010. The petitioner does not want any of his existing properties to be protected. Rather he is claiming potential right in respect of the property, which is dependent upon the grant of declaration by the competent civil court. Remedy of the petitioner would lie else where. Accordingly, we refuse to interfere in the writ petition. Writ petition, accordingly, is dismissed.
