connection with the Complaint of Un-official Respondents 4 and 5 relates to the house repairs not completed it is nothing but interference into with the Civil Dispute all are illegal, unlawful, curtailing the rights of petitioner under Article 14,19,21 of the Constitution of India Consequently to direct the Respondent Police R-3 not to interfere nor harass the petitioner by any means even without registration of any Crime nor following the process of Law in the interest of the justice and pass IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased prayed that this Hon'ble Court to direct the Respondent Police R-3 not to interfere nor harass the petitioner by any means even without registration of any Crime nor following the process of Law in the interest of the justice and pass such other relief or reliefs as the Hon’ble court deems fit and proper in the circumstances of the case . This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... to issue a Writ or Order or Direction more particularly in the nature of a Writ of Mandamus declaring the action of the Respondent Police particularly R-3 calling the petitioner to the Police Station Continuously likewise attending to the petitioner house, harassing only in-connection with the Complaint of Un- official Respondents 4 and 5 relates to the house repairs not completed it is nothing but interference into with the Civil Dispute all are illegal, unlawful, curtailing the rights of petitioner under Article 14, 19, 21 of the Constitution of India Consequently to direct the Respondent Police R-3 not to interfere nor harass the petitioner by any means even without registration of any Crime nor following the process of Law in the interest of the justice and pass...”
2. Heard Sri R.Siva Sai Swarup, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Sri Md.Farooq, learned Assistant Government Pleader for Home would submit that based on the complaint made by the unofficial respondent Nos.4 and 5, a crime has been registered against the petitioner. However, that the police are not interfering in the civil disputes between the parties. 4. Recording the said submissions, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties. There shall be no order as to costs.
