IA NO: 2 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents seizure of infringing copies (cinema prints, CDs, digital formats, OTT masters, etc.) of the movie “MIRAI” and direct Respondents 3, 4 and 5 to pay compensation/damages to the petitioner for infringement of his copyright and moral rights. It is submitted by the petitioner herein, pending disposal of the above writ petition, and pass Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue an appropriate Order, Directions or Writ Particularly one in the nature of WRIT OF MANDAMUS declaring that the action of the respondents i.e., The continued exhibition, broadcasting, telecasting, OTT streaming and distribution of the Telugu movie “MIRAI” by Respondents 3 to 6 is illegal, arbitrary, ultra vires, unconstitutional and violative of the petitioners copyright in his original literary work “The Book of Destruction”; And Direct Respondents 1, 2, 7 and 8 to forthwith prohibit further screening, distribution, telecast or OTT release of the said movie until adjudication of the petitioner’s claims And Direct seizure of infringing copies (cinema prints, CDs, digital formats, OTT masters etc.,) of the movie “MIRAI” consequently direct Respondents 3, 4 and 5 to pay compensation/damages to the petitioner for infringement of his copyright and moral rights and to pass...…”

Learned Counsel for the petitioner would submit that this Court may pass appropriate orders, giving liberty to the petitioner to pursue the matter before appropriate forum.
4. Accordingly, the Writ Petition is disposed of, granting liberty to the petitioner to work out his remedies before the appropriate forum according to law. There shall be no order as to costs.
