After hearing counsel for the petitioner, and by staying the arrest of the petitioner, on 04.09.2025, following order was passed by this Court:- “1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name & age of Petitioner (s) FIR No. Date Section(s) Police Station District Bablu, aged about 20 years 180 11.05.2025 21(b), 27(a) of NDPS Act City Fatehabad Fatehabad 2. Notice of motion. 3. On advance notice, Mr. Kanwar Sanjiv Kumar, AAG, Haryana, puts in appearance on behalf of the respondent – State. 4. Stunning facts have emerged in the present case, wherein one Kashmiro, mother of the petitioner, was apprehended with 30.57 grams of LAVISHA 2026.01.23 16:10 I attest to the accuracy and integrity of this document PHHC, Chandigarh CRM-M-49166-2025 -2- heroin. Based on her disclosure statement, petitioner’s name has been implicated in the matter. 5. Learned State counsel submits that, as per the disclosure statement of the said Kashmiro, it is the petitioner who allegedly supplied the said contraband to her. 6. Upon inquiry by the Court, learned State counsel further informs that petitioner’s father, namely Gurumukh Singh, is involved in total 45 criminal cases, out of which, 6 pertain to offences under the NDPS Act. At present, petitioner’s father is lodged in jail. In addition, petitioner himself is facing total 9 criminal cases, out of which, 3 are under the NDPS Act, while the remaining are under the Gambling Act. 7. Allegation against the petitioner is that he procured heroin from an external source, and subsequently supplied it to his mother. It is pertinent to note that mother of the petitioner, namely Kashmiro, has not been previously found involved in any similar criminal activity. The prosecution will be required to establish this allegation against the petitioner through strong and credible evidence during the course of trial. 8. List again on 06.11.2025. 9. Let a status report be filed by learned State counsel, clearly reflecting the stand of the prosecution. 10. Meanwhile, petitioner shall not be arrested. 11. However, issue of joining of investigation by the petitioner would be examined on the next date of hearing, after reviewing the status report, which is yet to be filed by learned State counsel.” 2. Learned State counsel has filed status report dated 04.11.2025, which is already there on the record. 3. As per the status report, petitioner is involved in nine other criminal cases, including cases under the NDPS Act. That as per record the petitioner/accused is involved in Nine other criminal cases details of which as below:- (i). FIR No. 142 dated 27.03.2021 under section 13A, 3, 67 of Gambling Act P.S. City Fatehabad. (ii). FIR No. 470 dated 26.09.2021 under section 13A, 3, 67 of Gambling Act P.S. City Fatehabad. (iii). FIR No.539 dated 22.10.2021 under section 13A, 3, 67 of Gambling Act P.S. City Fatehabad. (iv). FIR No.475 dated 05.09.2022 under section 13A, 3, 67 of Gambling Act, 61,4,20 of Ex. Act P.S. City Fatehabad (v). FIR No.555 dated 14.10.2022 under section 158, 61, 85 of NDPS Act Fatehabad. (vi). FIR No.285 dated 28.05.2023 under section 21A, 27A, 61, 85of NDPS Act P.S. City Fatehabad (vii) FIR No.485 dated 05.09.2023 under section 21B, 27A, 61, 85 of NDPS Act P.S. City Fatehabad (viii) FIR No.557 dated 14.10.2023 under section 399, 420 of IPC and 25, 54, 59 of Arms Act P.S. City Fatehabad (ix) FIR No.180 dated 11.05.2025 under section 21B, 27A, 61, 85 of NDPS Act P.S. City Fatehabad.” 4. Apart this, father of the petitioner i.e. Gurmukh is also involved in 45 other criminal cases. 5. As already noticed in the order dated 04.09.2025, recovery of 30.57 grams of heroin has been effected from the mother of the petitioner, who, in her disclosure statement, has named the petitioner as the supplier of the alleged contraband. 6. In view of the above, this Court does not find any substantial reason to extend the concession of discretionary relief in the form of anticipatory bail to the petitioner in the present case. Accordingly, present petition is dismissed.
