Accordingly, both these Bail Applications are being disposed of by a common order. Heard the parties. Petitioners have been made accused in connection with Muffasil P.S. Case No.159 of 2024, for the offences registered under Sections 103(1), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act, pending in the Court of learned Chief Judicial Magistrate, Hazaribagh. On 06.08.2024 at about 9:30 A.M., husband of the informant namely Parshuram Prasad left his house. Thereafter, at about 7:50 P.M., his dead body was recovered from a place near Lakhe cemetery. Suspicion has been raised against named accused persons that due to previous enmity; they might have committed murder of the deceased. It was submitted that petitioners are not named in the F.I.R. It was further submitted that name of the petitioners has come in the confession of co-accused persons. Learned A.P.P. has opposed the prayer for bail and submitted that apart from confession, the CDR report shows that petitioners were present -2- near the place of occurrence at the time of occurrence. Considering the fact that there is no cogent material against the petitioners on the record, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh, in connection with Muffasil P.S.
