1. The State Of Rajasthan Through Principal Secretary, Rural Development And Panchayati Raj Department, Jaipur
2. The Secretary, Department Of Personnel, Secretariat Rajasthan, Jaipur ----Respondents For Petitioner(s) : Mr. Hanuman Choudhary For Respondent(s) : Ms. Sweekriti Sharma for Mr. Archit Bohra, AGC HON'BLE MR. JUSTICE GANESH RAM MEENA Order 26/11/2025
1. This writ petition has been filed by the petitioner with a prayer to make fixation of the pay of the petitioner under the scheme of ACP in the Rajasthan Administrative Services by counting his past services rendered in Aided Institution from the period 08.08.1988 to 24.10.1995 and so also to quash the communication dated 16.01.2024, whereby the claim made by the petitioner was rejected by the respondent Department Of Personnel. 2. Considered the submissions made at Bar. 3. As per the facts on record, the petitioner is said to have been initially appointed on the post of College Lecturer (Economics) in Aided Institution namely; Shri Pragya
[2025:RJ-JP:47998] (2 of 2) [CW-8689/2015] Mahavidyalaya, Bijainagar, Ajmer and worked from 08.08.1988 to
24.10.1995. Later on the petitioner was appointed on the post of College Lecturer after selection being made by the Rajasthan Public Service Commission and rendered services upto
26.12.1999. Thereafter, the petitioner was selected for the Rajasthan Administrative Services where he joined duty on
20.12.1999. 4. The provisions of Rule 5(IX) of the Rajasthan Voluntary Rural Education Service Rules, 2010 (hereinafter to be referred to as 'the Rules of 2010') speaks that the Rajasthan Civil Services (Pension) Rules 1996, shall not be applicable to such candidates. 5. The learned counsel for the petitioner is not able to show that under which provision the services rendered under an Aided Institution, can be counted for the purpose of grant of ACP and pay fixation under the revised pay scale Rules of 2008 &
2013. 6. As per the provision of law, only the services rendered under the State Government and certain undertakings can only be counted for the purpose of fixation of pay and other benefits as per Rajasthan Service Rules. There is no provision for counting the services rendered under the Aided Institution for fixation of pay of a government servant.
Hence, the Court finds no merit in the writ petition. 7. Accordingly, the writ petition is dismissed. (GANESH RAM MEENA),J Shruti /73
