Order 31/10/2025
1. Both these criminal misc. petitions have been preferred with the prayer to quash FIR No.30/2024 registered with the Police Station Atalbandh, District Bharatpur for the offences punishable under Sections 295-A, 298 and 325 IPC.
2.
Learned counsel appearing on behalf of the Pastor Bijendra Singh submits that the FIR was registered with the
(2 of 2) [CRLMP-3954/2025] allegations against certain persons that they were forcing the complainant with other people for conversion their religion. Counsel submits that the petitioner Pastor Bijendra Singh is not even named in the FIR. Counsel submits that without any basis, the petitioner has been falsely booked in this case without there being any evidence against him. Counsel submits that under these circumstances, the impugned FIR lodged against the petitioner is liable to be quashed.
3. Per contra, learned Public Prosecutor opposed the prayer and submitted that the allegations levelled in the FIR reveal commission of cognizable offence, which is required to be investigated by the Investigating Agency, hence, interference of this Court is not warranted.
4. Having regard to the facts and circumstances of the case, this Court is of the view that the allegations made in the FIR are subject matter of investigation. The correctness of the allegations cannot be examined and adjudicated by this Court under its inherent jurisdiction contained under Section 528 BNSS at this stage. The petitioner may file a representation before the Investigating Officer, who shall consider the same strictly in accordance with law.
5. With the aforesaid observations, both the instant criminal misc. petitions stand disposed of. The stay application and all pending applications, if any, also stand disposed of.
