THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 24394 OF 2025
ORDER:- The present Writ Petition is filed questioning the inaction of the Respondent Nos. 4 to 6 in implementing the Proceedings in Rc.No. A2/539/2025, dated 25.07.2025 as illegal and arbitrary. 2. The Petitioners have been initially appointed as Village Surveyor (Grade-Ill) in the A.P.Survey and Land Records Subordinate Service, vide Proceedings, dated 14.11.2019 by the Respondent No.7. Initially the Petitioner No.1 was posted at Vardhaiahgaripalli Village Secregtariat, Rajampety Mandal; the Petitioner No.2 was posted at Salabad Village, Vontimitta Mandal and the Petitioner No.3 was posted at Pullaredypalli, Kalasapadu Mandal. While so, the Petitioners were transferred to T. Sundupalli Village, Settipalli Village, Railway Koduru Mandal and Anantarajupet-2 Village of Annamayya District respectively. Fresh counseling was conducted pursuant to G.O.Ms.No.23, dated 15.05.2025 and G.O.Ms.No.5, dated
12.06.2025. As the Petitioners were transferred to the places, which they have not opted, they had given a representation. requesting to reconsider the order of transfer. 3. It is also stated that the Petitioners while transferring of the places which are geographical disadvantage and considering the family scenario, the Petitioners are finding it extremely difficult to attend the office at the transferred places. It is also stated that the District Survey and Land Records
Officer i.e Respondent No.5 had addressed a letter to the Respondent No.6 i.e The District Survey and Land Records, Annamayya District, vide RC.A2/539/2025, dated 25.07.2025 requesting to be transferred the Petitioners to Letapalli Village, Kamalapuram Mandal, YSR Kadapa District, K. Thimmapuram Village, Muddanur Mandal, YSR Kadapa District and Bheemagundam Village, Peddamudiem Mandal, YSR Kadapa District respectively along with others. But no further steps had been taken thereof. Hence, the present Writ Petition came to be filed. 4. Learned Assistant Government Pleader for Services-I for the Respondents, on instructions, would submit that the proceedings were issued during period when the transfer ban was relaxed and transfer ban shall come into force with effect from 01.07.2025. It is further contended that as long as ban is in vogue the Petitioners case cannot be considered for transfers. The Petitioners did not join in the new station as per transfer orders, have been making representations requesting for modification of the same. 5.
Considering the difficulties expressed by the Petitioners, without going into the entitlement of the right of the Petitioners for being considered in the vacant posts mentioned in the letter dated 25.07.2025, this Court is inclined to dispose of the Writ Petition at the stage of admission, with the consent of both the counsel with following directions: i) The Petitioners are directed to submit fresh representation to the Respondents by expressing their grievance with regard to proceedings issued
pursuant to G.O.Ms.No. 5, dated 12.06.2025 within two (02) weeks from the date of receipt of a copy of this order. ii) On such submission, Respondents are directed to examine the case of the Petitioners individually and to re-examine the orders of transfer iii) in the event of the difficulties expressed by the Petitioners are found to be genuine, the Respondents shall take further action in terms of letter, dt.25.07.2025 issued by the Respondent No.5 within eight (08) weeks thereafter. 6. With the above direction, the Writ Petition is disposed of. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed. Sd/- K.
