This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... writ of Mandamus declaring the action of the 3rd respondent in not registering the FIR considering my report, dt- 04-07-2024 under Section 173 of Bharatiaya Nagarik Suraksha Sanhita, 2023, and the law settled by the Honble Apex Court in Lalita Kumari vs. State of U.P and Sindhu Janak Nagargoje vs. State of Maharashtra, is illegal, arbitrary, unjust and viloative of Articles 14 and 21 of the constitution of India. And consequently direct the respondents to initiate action against the 3rd respondent for not registering the FIR and direct the respondents to register the FIR in pursuance of the report dt- 04-07- 2024, in accordance with law.”

2. Sri N.Mohan, learned counsel for the Petitioner would submit that the Police have not been registering the case based on the complaint given by the Petitioner.
3. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that the contents of the complaint given by the Petitioner, are of civil nature. As such, the Police have not registered any case based on the said complaint.
4. Considering the submissions made, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out his remedies before the appropriate forum in accordance with law. There shall be no order as to costs.
