1. The petitioner preferred the present writ petition under Article 226 of the Constitution of India seeking a direction towards the respondents to give employment to the petitioner as per the Rehabilitation Policy and in light of the enquiry report dated 03/11/2023 submitted by the SDO Revenue, Korba. For which application dated 09/09/2024 (Annexure P/5) submitted by the petitioner is pending consideration.

Learned counsel appearing for the petitioner would submit that the land of the petitioner acquired by the authorities for the purpose of SECL “Kusumunda Open Cast Project”. During the process of acquisition, the Projected Affected Persons (PAPs) including the petitioner submitted their objections regarding grant of employment. Thereafter, the revenue authorities conducted the enquiry with regard to the land oustees and submitted detailed report before the Collector wherein it has been categorically mentioned that the land of the petitioner has been acquired for the purpose of SECL. Thereafter, the petitioner submitted an application on 09/09/2024 (Annexure P/5) before the Chief General Manager, SECL, Kusmunda but till date the same has not been considered and decided by the said authorities.

Learned counsel appearing for the respondent/SECL submits that if the application is still pending before the authority, the same shall be decided, in accordance with the relevant provisions,

4. I have heard learned counsel for the parties and perused the documents.

As the application is pending since 09/09/2024, the respondent authorities/ SECL is directed to consider and decide the application/representation dated 09/09/2024 (Annexure P/5) filed by the petitioner, in accordance with law and on its own merits, within a period of three months from the date of receipt of a copy of this order.
6. With the aforesaid direction, this writ petition is disposed of.
