The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 73/2024, registered at 2 Police Station Pratappur, District- Surajpur (CG) for the offence punishable under Section 294, 506, 323, 307, 302, 147, 148, 149 of IPC. 2. The prosecution story in brief is that on 28.02.2024 at about 12 noon, her elder son Kaleshwar Yadav was near the grocery shop of Rajendra Yadav of the village, at the same time, Nandu Pando, Sadharan Pando, Siyaram Pando and other of Pandapara Durti came and regarding old grudge, started abusing Kaleshhwar Yadav’s mother and sister with vulgar words and threatened to kill him and started beating him with a stick and sickle. Hearing the quarrel and noise, the applicant’s husband Rup Narayan, brother- in-law Deep Narayan and Harilal Yadav came and tried to intervene, but all of them also started abusing with vulgar words and threatened to kill them and started beating them with a deadly attack with a stick and sickle, due to which all four of them got severely injured on their bodies. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant is in judicial custody since 04.03.2024. Also, the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicants. 4. On the other hand, learned counsel for the State opposes the bail application and contended that the applicant is not entitled for grant of bail. 3 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Siyaram Pando involved in Crime No. 73/2024 under Section 294, 506, 323, 307, 302, 147, 148, 149 of IPC at Police Station Pratappur, District- Surguja, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8.
