ORDER
1. This writ petition is filed aggrieved by the action of the respondents for non-payment of the bills for the works executed by the petitioner. 2. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondent- Corporation. 3. The learned counsel for the petitioner submits that the petitioner has executed the works, viz.,(i) repairs to the Existing Damaged CC/BT roads for (Pot Holes) in 1-town area in Eluru Municipal Corporation through agreement No. 89/2024-25, Dt.07.10.2024, (ii) repairs to the Existing Damaged CC/BT roads for (Pot Holes) in 1st to 6th Division in I- town area in Eluru Municipal Corporation through agreement No. 122/2024-25, Dt.30.10.2024, (iii) frontend Loader engaged for removal of jungle at various places in Eluru Municipal Corporation through agreement No.182/2024-25, Dt.08.10.2024, (iv) providing Toilets Repairs and water supply pipe line and electrical repairs at Nalladibba Toilets in 1st division through agreement No.55/2024-25, Dt.26.06.2024, (v) Providing water supply, drums and tractors at NOVA College, Ramachandra College and Gurukula Patasala for CM Oath

taking (Pramana Sweekaram) Programme in Eluru Municipal Corporation through agreement No.183/2024-25, Dt.08.10.2024, (vi) Providing quarry spall for low-lying areas at dump site in Ponangi through agreement No.267/2023-24, Dt.30.10.2023, (vii) Supply of water tankers for summer adverse season for the month of May 2024 in Il-town area in Eluru Town through agreement No.64/2024-25, Dt.24.07.2024, (viii) Restoration of patch work at Lunani Nagar Main Road in 49th Division through agreement No.147/2023-24, Dt.12.07.2023, (ix) Supply of water tankers for summer adverse season for the month of April 2024 in Il-town area in Eluru Town through agreement No.65/2024-25, Dt.24.07.2024, (x) Repairs to existing potholes for CC and BT roads in ward sachivalayam (8,9,10,14,21 in Tangellamudi-2) in Eluru Municipal Corporation through agreement No.127/2022-23, Dt.06.03.2023, (xi) Filling the BT potholes at Old Bus Stand Flyover Bridge and Low Bridge in Eluru Municipal Corporation through agreement No.344/2023-24, Dt.27.12.2023, (xii) Providing greenery in ASR Stadium footpath in Eluru Municipal Corporation through agreement No.333/2023-24, Dt.23.12.2023, (xiii) Repairs to existing potholes for CC and BT roads in ward sachivalayam (Tangellamudi-2) in Eluru Municipal Corporation through agreement No. 128/2022-23, Dt.06.03.2023, as entrusted by the 4th respondent-Corporation. 4.
4. The learned counsel further submits that the petitioner duly executed all the works to the satisfaction of the 4th respondent-Corporation and

thereafter submitted a final bill aggregating for a sum of Rs.43,30,078/-. It is submitted that the progress of the work was recorded in the M book and the bills were approved. However, no payment has been forthcoming. 5. During the course of the hearing, the learned Standing Counsel appearing for the Corporation does not dispute the submissions made by the petitioner with respect to the completion of the work undertaken. 6. Considering the submissions, respondents 2, 4 and 5 are hereby
directed to verify and release the payments due payable to the petitioner as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of this order.
7. Accordingly, the writ petition is disposed of. No costs.
8. Pending miscellaneous petitions, if any, shall stand closed.
