1. The petitioner refers to a contract dated 21st June, 2024 issued in his name by the Ministry of Defence for providing manpower outsourcing services- minimum wage - unskilled: others : Sweeper. The service start date was 27th June, 2024 and the service end date was 26th June, 2025.
2. The petitioner submits that the authority did not permit the petitioner to engage his labourers but insisted upon the petitioner to engage the labourers who were already working as the petitioner did not accede to the request made by the respondent authority, the authority did not permit the petitioner to perform the work.
3. It has been submitted that entire security deposit was paid by the petitioner and the authority ought to allow the petitioner to perform the service.
4. Learned advocate appearing on behalf of the respondents is not ready with proper instruction.
5. From the documents annexed to the writ petition, it appears that the time period of the contract
2 has already expired. At this stage, whether it will be possible for the department to accept the service of the petitioner is questionable.
6. Nevertheless, as it appears that the petitioner was awarded a contract and he alleges that he was not allowed to perform in terms of the contract, accordingly, the instant writ petition is disposed of by directing the General Manager, Ministry of Defence, Department of Defence Production, the respondent no.3 herein to take into consideration the request of the petitioner to permit him to act in terms of the contract after the same is reissued in his name.
7. Steps shall be taken by the aforesaid respondent at the earliest.
8. In the event the respondents do not accept the prayer of the petitioner, then the same shall be intimated to the petitioner immediately thereafter.
9. The writ petition stands disposed of.
10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
