JUSTICE S.SUNIL DUTT YADAV) The present petition was filed seeking for initiation of proceedings for contempt in light of the disobedience of the interim order dated 13.07.2023 in W.P.No.201846/2023. Interim order is produced at Annexure-A in which there was a direction that the respondents were restrained from appointing any new personnel and/or taking new loan and/or selling any of the property of the Society till the next date. At the outset it must be noticed that the interim order was till the next date. - 4 - NC: 2025:KHC-K:1317-DB CCC No.200135 of 2024 2. It is the case of the complainant that in terms of Annexure-B dated 13.09.2023 it comes out that in terms of reference No.4 steps were taken contrary to the interim order to fill up the post. Accordingly, it was submitted that there was willful disobedience of the order. 3. The affidavit at the first instance was filed on 11.02.2025 along with annexures. Para No.7 of the said affidavit reads as follows: “7. That apart, it is submitted, in pursuance to the interim order dated 13.7.2023, there is no appointment made by the respondent-1 to 6/accused-1 to 6, therefore on this count also the complainant cannot be content(sic) that responident-1 to 6/accused-1 to 6 wilfully disobeyed the interim order passed in the writ petition.” 4. The learned counsel for the respondents submits that they would be bound by such undertaking and no appointment would be made contrary to interim - 5 - NC: 2025:KHC-K:1317-DB CCC No.200135 of 2024 order in force.
