“The present petition has been filed under Section 482 of the BNSS, 2023 for grant of pre-arrest bail to the petitioner in case FIR No.122 dated 15.03.2019, under Section 379 of the Indian Penal Code, 1860 (later on Section 201 of IPC added) registered at Police Station City Tohana, District Fatehabad, Haryana.
Learned counsel appearing on behalf of the petitioner inter alia contends that the petitioner was arrested in a case registered under the NDPS Act in the year 2019 wherein the Motorcycle bearing registration No. PB13AX-9124 had also been recovered from him. He contends that now the instant FIR has been registered by making a reference that the motorcycle which was recovered from him was a stolen property. He contends that no recovery is to be effected from the petitioner and moreover, the offence would not be made out since the petitioner is stated to have purchased a stolen property and did not carry out the theft himself. He contends that the petitioner is ready and willing to join the investigation as and when so required. Notice of motion. Ms. Dimple Jain, DAG, Haryana appears and accepts notice on behalf of respondent-State. JATIN 2025.07.11 16:17 I attest to the accuracy and integrity of this document
