For petitioner : Mr.E.Senthil Kumar Page 1 / 5 https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis CRP NPD.No.2971 of 2025 O R D E R Challenge has been made against the lok adalat award passed in the Lok Adalat Case No.369 of 2024 dated 14.09.2024, in the present Civil Revision Petition. 2. The Lok Adalat Award is mainly challenged on the ground that the payment which has already been made by the petitioner, particularly before the passing of the award has not been given credit. Therefore, according to him, he has paid more than the entitlement. Therefore, the award passed cannot be sustained in the eye of law. 3. It is relevant to note that the petitioner himself was present during the Lok Adalat and he had agreed for the terms of the settlement. The suit claim is for a sum of Rs.5,98,000/- wherein he has clearly agreed to pay a sum of Rs.4,00,000/- after full negotiation and agreed to pay a sum of Rs.25,000/- on 10.10.2024, a sum of Rs.25,000/- on 10.11.2024 and the remaining sum of Rs.3,50,000/- before the month of March, 2025. Now the grievance of the petitioner is that even before the suit, he has paid more than Rs.6 lakhs to the petitioner. Therefore, according to him, that amount has not been given credit. It is relevant to note that the amount claimed in the suit has to be paid in the year 2021. Be that as it may. 4. The suit has been filed in the year 2023. If really, the said amount has been paid, nothing prevented the revision petitioner to seek for credit of that amount while negotiations during the lok adalat. Having agreed to the terms of the agreement, now he cannot challenge the lok adalat award on the ground of alleged discharge. Hence, I do not find any merits in this Civil Revision Petition. 5. Accordingly, this Civil Revision Petition is dismissed. No costs.
