The writ petitioner is aggrieved by non- implementation of the order dated December 27, 2023 passed by the District Land and Land Reforms Officer, Purba Medinipur being the Appellate Authority under Section 19(1) of the Right to Information Act, 2005 (in short „said Act‟). Being aggrieved by the non-supply of the information only the application of the writ petitioner under the relevant provisions of the said Act, the writ petitioner approached the Appellate Authority under Section 19(1) of the said Act. The said appeal has been
disposed of by an order dated December 27, 2023 whereby the Block Land and Land Reforms Officer, Bhagwanpur-II being the State Public Information Officer has been directed to provide the writ petitioner (appellant in the said appeal) the information which the writ petitioner had sought for in the said application made under the said Act. The writ petitioner complains that despite such
order having been made, the respondent/State Public Information Officer has not provided the complete information. The writ petitioner contends that from the certified copies of the RS Record of Rights it would appear that the authorities have recorded their remarks as „‟Nei‟ (transliteration of the word in Bengali

vernacular) in the remarks column with regard to Khatian No. 4181 and th e remarks column as regards Khatian No. 200 has been left blank. As regards Khatian No. 2895, there is a cross („X‟) in the remarks column; similarly as regards Khatian No. 3382, there is again a cross („X‟) in the remarks column. The writ petitioner complains that despite the certified copy of the RS Record of Rights showing the aforesaid in the remarks in the remarks column, upon the order being passed by the Appellate Authority, information as regards Khatian No. 2895 has been provided and information as regards the other Khatians have not been provided as yet. Learned Advocate for the State respondents hands up a copy of the instruction given to him by the said Block Land and Land Reforms Officer wherefrom it appears that while certified copy of one of four Khatians requested for by the writ petitioner is available and has been supplied to the writ petitioner, the records in respect of the other three Khatians are in torn condition and they are “required to be reconstructed as per the Govt. Rule”. A copy of the instruction is taken on record. In view of the aforesaid, this writ petition is
disposed of by directing the respondent no. 4 to take expeditious steps for reconstruction of the documents in accordance with law, preferably within a period of six weeks from the date of communication of this order. Upon such reconstruction of the said records pertaining to the relevant Khatians, the concerned Block Land and Land Reforms Officer shall be obliged to supply the certified copies of Khatian Nos. 4181, 200 and 338, as requested by the writ petitioner in her application for information, forthwith and in any case not later than one week from the date of such reconstruction.

There shall, however, be no order as to costs.
