PUBLIC PROSECUTOR The Court made the following: ORDER: ...RESPONDENT/COMPLAINANT The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 1 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 and 2 for granting of pre-arrest bail in connection with Crime No.76 of 2025 of Kollipara Police Station Guntur District, registered for the alleged offences punishable under Sections 118(1), 351(2) The BNSS d 2 read with 3(5) of the Bharatiya Nyay Sanhita, 2023" on the allegation that the Petitioners/Accused Nos.1 and 2 dangerous weapons. 2. Heard the learned Counsel f(j)r the Petitioners and the learned Assistant Public Prosecutor. The petitioners/accused Nos.1 and 2 are involved in voluntarily causing hurt using 3. are the elder brother and father of the de-facto complainant. The allegation against the petitioners/accused Nos.1 and 2 is that the petitioners beat the de-facto complainant and the petitioner No.1 forcibly made the de-facto complainant to drink pesticides. He was admitted in hospital on 17.07.2025. How long he treatment is not mentioned. However, the learned Assistant in the hospital taking Public Prosecutor submits that the petitioners suffered only simple injuries. They are civil disputes pending in between the petitioners and the de-facto complainant. The petitioner No. 1/Accused No.1 lodged a complaint in Crime No.77 of 2025 against the de-facto complainant alleging that the de-facto was complainant beat the petitioners with spade and caused bleeding injuries to the heads of the petitioner No.2. Further the mother of the de-facto complainant lodged against the de-facto complainant it was registered a report as case in Crime No. 127 of 2023. 4. Considering the facts and circumstances of the case, the gravity and nature of the allegations, this Court is inclined to grant pre-arrest bail to the Petitioners/Accused Nos.1 and 2. ^The BNS , 3 5. In the result, the Criminal Petition is allowed with the following conditions; i. In the event of arrest of the Petitioners/Accused Nos.1 and 2 they shall be enlarged on bail -subject to them executing a personal bond for a sum of R^.IO’OOO/- (Rupees Ten Thousand Only), with two sureties for the (ike sum each to the satisfaction of the arresting police officials; ii. The Petitioners/Accused Nos. 1 and 2 shall make themself available for investigation as and when required; iii. The Petitioners/Accused Nos. 1 and 2 shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The Petitioners/Accused Nos. 1 and 2 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. V. The Petitioners/Accused Nos. 1 and 2 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. Vi.
