GP FOR SERVICES I The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY W.P.No.32186 of 2025 ORDER: The present Writ Petition is filed to declare the action of the Respondents in not considering the case of the Petitioner for promotion to the post of 8Superintending Engineer9 on the ground of pendency of Disciplinary Proceedings vide G.O.Rt.No.433 MA & UD (Vig.I) Department, dated 28.05.2024, as illegal and arbitrary. 2. The Petitioner is working as Executive Engineer in Public Health and Municpal Engineering Department since 2007. It is stated that now he is eligible and qualified for promotion to the post of 8Superintending Engineer9. While so, a Charge Memo stated above was issued to the Petitioner on 28.05.2024, making certain allegations. 3. It is stated that after serving the above Charge Memo, the Petitioner submitted 8Statement of Defence9 refuting the aforesaid Charge and the enquiry is stated to be pending. 4. Learned Counsel for the Petitioner submits that the Petitioner is now due for promotion to the post of 8Superintending Engineer9, but the Respondents are refusing to consider the case of the Petitioner for promotion 3 to the said post on the ground of pendency of disciplinary proceedings. Hence, the present Writ Petition. 5. Having heard the respective submissions, this Court is of the opinion that the case of the Petitioner can be considered for promotion to the post of 8Superintending Engineer9 in terms of G.O.Ms.No.257, dated 10.06.1999. 6. Accordingly, the Writ Petition is disposed of with following directions: i) The Respondents are directed to consider the Petitioner9s case for promotion to the Post of 8Superintending Engineer9 subject to the Petitioner possessing requisite qualifications in terms of G.O.Ms.No.257, General Administration (Ser.C) Department, dated 10.06.1999. (ii) There shall be no order as to costs.
