JUSTICE N. UNNI KRISHNAN NAIR ORDER Date : 04.06.2025 Heard Mr. Khoda Tama, learned counsel, appearing on behalf of the accused applicant. Also heard Mr. Token Ete, learned Addl. P.P., Arunachal Pradesh. The present bail application has been instituted by the accused applicant, namely, Smti. Asha Miji, praying for pre-arrest bail in connection with Seppa Women Police Station Case No. 09/2025 registered u/s. 316(2)/85/82(1)/3(5) of the Bharatiya Nyaya Sanhita(BNS), 2023. Page No.# 2/3 The aforesaid police case was so registered basing on an First Information Report(FIR), dated 28.05.2025, lodged by one Smti. Amak Singhi. A perusal of the same would go to reveal that the allegations raised therein, in the said First Information Report(FIR), pertains to a matrimonial dispute existing in the matter between the informant and her husband with the involvement of the applicant, herein. In view of the allegations set-out in the First Information Report(FIR), dated 28.05.2025, this Court is of the considered view that the custodial interrogation in the matter, would not be called for. Accordingly, this Court is of the considered view that the applicant, herein, is liable to be enlarged on pre-arrest bail. In view of the above; it is hereby directed that in the event of her arrest in connection with Seppa Women Police Station Case No. 09/2025 registered u/s. 316(2)/85/82(1)/3(5) of the Bharatiya Nyaya Sanhita(BNS), 2023; the accused applicant, namely, Smti. Asha Miji, shall be enlarged on pre-arrest bail on furnishing a bail bond of Rs. 15,000/-(Rupees Fifteen Thousand), with a surety of like amount subject to the satisfaction of the arresting authority on the following terms and conditions: (i). She shall appear before the I.O. of the case within a period of 7 days from today for recording of her statement. (ii). She shall fully cooperate with the investigation of the case. She shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Police Officer and/or tamper with the evidence of the case.
