Heard Sri Sundeep Shukla, learned counsel for the petitioner and Ms. Shruti Malviya, Brief Holder. 2. It is not under dispute that petitioner was convicted of a serious charge for committing gang rape of a minor girl and was convicted and sentenced to 20 years vide judgment and order dated 20.6.2023. 3. The petitioner an Assistant Teacher filed a Criminal Appeal No.7791 of 2023 wherein vide order dated 2.8.2024 an order of suspension of sentence was passed. 4. It is not under dispute that petitioner has attained the age of superannuation on 31.3.2016. 5. In the aforesaid circumstances, petitioner sent a notice on 12.12.2024 through his Advocate to release pension of petitioner which was replied by the respondent no.4 assigning reasons for withholding pension vide Government Orders dated 8.2.1978 and 10.12.2012. 6. Learned counsel for the petitioner submitted various arguments, however, only argument which has merit at this stage is that till date State Government has not taken any decision which is the appropriate authority to withhold pension in terms of Civil Services Regulations. 7. Ms. Shruti Malviya, Brief Holder submits that pension of petitioner was rightly withheld on basis of above referred Government Orders. She referred following relevant part of Government Order dated 8.2.1978 which is reproduced hereinafter: "2-इससी ससंदरर मम ललोक ससेववा आयलोग कसे पत्र ससंख्यवा जसी -III-979/17- ए०डसी०ससी०-68-69, ददनवासंक 30 अक्टटबर, 1976 मम आयलोग कवा यह मत पवाप हहलवा हहै दक अदवालत कसे फहै सलसे कसे बवाद जजतनसे ददन तक अपरवाधसी व्यदक्ति जसेल मम रहसे कसे वल उतनसे हसी समय तक ककी पमशन जब्त हलोनसी चवादहयसे दकन्ततु यदद जसेल जवानसे ककी दतजथि तक पमशन दमल गई हलो तलो वह ववापस न करवाई जवाय। शवासन नसे ललोक ससेववा आयलोग कसे उपयतुरक्ति मत पर दवचवार करनसे कसे उपरवान्त यह दनररय जलयवा हहै दक दकससी पमशनर कसे दतुरवाचरर कसे कवारर दणणडत दकयसे जवानसे ककी दशवा मम उसनसे पमशन उस दतजथि ससे हसी रलोकनवा उदचत हलोगवा जजस दतजथि ससे उससे न्यवायवालय दवारवा सजवा दसी गई हलो दकन्ततु यदद जसेल जवानसे ककी दतजथि तक पमशन दमल गई हलो , तलो उससे ववापस नहहीं करवायवा जवायसेगवा।" 8. She fairly submitted that till date, State Government i.e. respondent no.1 has not taken any decision. 9. In the aforesaid circumstances, at this stage Court cannot pass an order to grant pension to the petitioner. 10. Taking note of above referred Government Orders and nature of proved criminal charges against the petitioner, this writ petition is disposed of with a direction that State Government will take a decision and pass a reasoned order taking note of facts of the present case as well as above referred Government Orders within a short period and it will be communicated to the petitioner.
