Mr. Siddhant Manral, learned legal aid counsel for the applicant. 2. Mr. Siddhartha Bisht, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State. 3. On the previous date Mr. Siddhant Manral was appointed as legal aid counsel on behalf of the applicant, since on that day counsel for the applicant was not present. 4. This is the Second bail application and the First bail application was dismissed as withdrawn with a liberty to file fresh on 21.02.2025. 5. The present applicant ‘Jasveer Singh’ S/o Kawal Singh is praying for regular bail in relation to First Information Report dated 21.01.2020 bearing Case Crime No. 12 of 2020, P.S. Pantnagar, District Udham Singh Nagar, wherein, the present applicant is implicated for the offences punishable under Sections 304, 323 and 504 of IPC. 6. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. He further submits that the applicant was arrested in the said crime on 25.01.2020 and since then he is in jail. He further submits that the prosecution is repeatedly seeking adjournments in the trial and uptill date only three witnesses have been examined though the chargesheet was filed on 19.04.2020 and the charges were framed on 02.01.2021. He submits that since the applicant is in jail since 25.01.2020 and the prosecution is taking repeated adjournments in the trial court regarding which the order sheet is also enclosed and submits that due to the lapse on the part of the prosecution the applicant be released on bail. 7. On the other side, learned State counsel have submitted that after the incident due to the Covid-19 pandemic the trial could not be proceeded and this is one of the reason, however, he has not disputed this fact that the applicant is 2025:UHC:3965 in jail since 25.01.2020 and furthermore the chargesheet has already been filed and the charges have also been framed, therefore, at this juncture there is no need of custodial interrogation of the present applicant. 8. After hearing the arguments of learned counsel for the parties and further taking into consideration that the chargesheet has already been filed on 19.04.2020 and the charges were framed on 02.01.2021 and uptill date only three witnesses have been examined and the applicant is in jail since 25.01.2020, this court is of the view that the applicant deserves for bail. 9. Accordingly, without expressing any opinion on the merit of the case, the second bail application is allowed. 10. Let the applicant ‘Jasveer Singh’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
