This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Case No. 9162 of 2022 in Sessions Trial No. 1067 of 2022 arising out of case crime no. 193 of 2022, under Sections 323, 504, 506, 304 IPC Police Station-Dubaulia, District- Basti pending in the Court of First Additional District and Sessions Judge, Basti expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant is the informant in the said case and the same is pending since 2022. It is also submitted that only two witnesses have been examined so far and the Court concerned is not taking proper interest in disposal of the said case. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. 6. It reveals from the perusal of the record that the trial Court is making all efforts to conclude the trial expeditiously as two witnesses of fact have been examined and P.W.3 after recording his examination-in-chief is not coming before the Court and bailable warrant has been issued against him. 7. In these circumstances, when the trial Court is itself attentive to procure the presence of the witnesses, I do not find any good ground to pass any direction to the trial Court for expeditious disposal of the case. 8.
