Applicant-Smt Gauri Verma has filed this application under Section 447 B.N.S.S., 2023 for transfer of Case No. 67355 of 2024; titled : State vs. Rohit Chauhan and another, arising out of Case Crime No. 185 of 2024, under Sections 323, 506, 494 IPC, Police Station Sirsaganj, District Firozabad pending before Additional Chief Judicial Magistrate-II, Firozabad to any other court of competent jurisdiction at District Agra. Upon hearing the learned counsel and considering his submissions, this Court finds that the applicant being complainant in the above mentioned case, herself has lodged the FIR at Firozabad and the trial of the said case is pending adjudication. Now, the applicant- complainant has approached this Court for transferring the said case to Agra on the ground that she is residing at Agra and is unable to contest the case at Firozabad. Since, the case was filed by the complainant-applicant herself at Firozabad, which is pending trial, and the sole ground seeking transfer of the case is based upon her convenience only. That apart, the distance between the two towns is only 50 kms. which is conveniently connected, therefore, this Court is not inclined to transfer the case. The application is dismissed.
