CORAM: HONOURABLE MR. JUSTICE JITENDRA KUMAR ORAL ORDER 2 29-05-2025 The present Criminal Writ petition has been preferred by the petitioner alleging that the Investigating Officer is not considering the representation regarding the relevant
facts of the case. This representation has been made to Director General of Police, Deputy Inspector General and Superintendent of Police, vide letter No. 7 dated 8.5.2025 showing that the petitioner was not present at the place of occurrence. Hence, the I.O. is failing in his duty to do proper and fair investigation.
2. I agree with the submission of learned counsel for
Patna High Court CR. WJC No.1010 of 2025(2) dt.29-05-2025 2/2 the petitioner that the investigation on the point raised by the petitioner in his representation, needs investigation by the Investigating Officer. The I.O. is required to be fair even to the accused during investigation and demand of fairness is that he should consider the representation made by the petitioner.
3. Hence, the petitioner is given liberty to file an application along with the representation to the concerned Judicial Magistrate to be forwarded to the concerned I.O. for
consideration and investigation on the point raised by the petitioner in his representation.
4. Accordingly, the present Criminal Writ petition stands disposed of.
