"The learned Additional Government Advocate for respondent Nos.1 to 9 fairly submitted that they would not violate the due process of law before taking over possession of any property for the purpose of widening of the road. In the case of the petitioners, she contended that they too would be proceeded against only in accordance with law. The petitioner is also seeking for a direction to respondent Nos.1 to 8 to pay him the compensation for using his property for widening of Tumkur-Sira road as provided under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Re-settlement Act, 2013 (hereinafter for short referred to as the “Act”). 3.
It is not in dispute that the Municipal Council passed a resolution on 27.05.2021 in the following terms:

As could be seen from the note put up to the Municipal Council, the Tumakuru Mahanagara Palike categorically admitted that they had utilized 945 square feet of the petitioner’s land for the purpose of

widening of the road and there was a requirement to pay him the compensation for this land. 5. The Municipal Council unanimously accepted this proposal for payment of compensation. In the light of the resolution, it is clear that the liability to pay the compensation was accepted by the Tumkur Mahanagara Palike unconditionally. 6.
Learned counsel also points out that a communication was also addressed to the Deputy Commissioner on 24.06.2021 by which the Palike had requested the Deputy Commissioner’s permission for purchasing the said land on outright purchase by offering a sum of Rs.22,000/- per square meter and building value of Rs.6,97,952/-.
7. It is stated that the said request to the Deputy Commissioner evoke no response and, as a consequence, the petitioner having lost 945 square

feet of the land way back in the year 2020 is still awaiting compensation.
8. The Tumkur Mahanagara Palike has now taken up the stand that the maintenance of the road as per the Government Order vest with the PWD and compensation, if any, was therefore required to be paid only by PWD.
9. In my view, this argument is wholly misconceived and is thoroughly unethical. The Government Order upon which reliance is placed merely indicates that the road which passed through a Municipal Council will have to be maintained by the PWD. On the basis of this circular, the Tumkur Mahanagara Palike cannot contend that it has no liability to pay compensation.
10. As already stated above, once the Tumkur Mahanagara Palike has accepted liability to pay compensation and pass resolution and, thereafter,

also sought the approval of the Deputy Commissioner for purchasing the land on an outright basis, it would be too late in the day for the Municipal Council to say that they have no liability to pay compensation.
11. An argument is also sought to advance by the
learned counsel Sri.Subramanya that, in the light of the Government Order, the Municipal Council could not have passed the resolution cannot also to be accepted. It is settled law that the Municipal Council has the right to pass the resolution and if the resolution was illegal, there was an appropriate remedy available to the Commissioner or the Government to take steps to cancel the same. The authorities having accepted the resolution, which was passed more than five years ago would not be entitled to resile from the said resolution and say that the compensation would have to be paid by the National Highway Authority of India (the NHAI).

12. The Tumkur Mahanagara Palike is directed to pay compensation in respect of 945 square feet of land as suggested by it to the Deputy Commissioner by paying the rate of Rs.22,000/- per square meter.
13. The Tumkur Mahanagara Palike is directed to make over this compensation to the petitioner within a period of one month from the date of receipt of the copy of this
order and the petitioner shall simultaneously execute a sale deed conveying the property to the Tumkur Mahanagara Palike.
14. It is also made clear that, if the liability to pay compensation is that of the PWD as contended by the Tumkur Mahanagara Palike, the PWD is directed to pay the compensation to the Tumkur Mahanagara Palike within a period of two months from the date of receipt of the claim from the Tumkur Mahanagara Palike.

It is made clear that irrespective of the liability to pay compensation, whether it is by the Tumkur Mahanagara Palike or the PWD or by the NHAI, the Tumkur Mahanagara Palike shall first pay the compensation to the petitioner and thereafter take steps to recover the same from either the NHAI or the PWD.
16. The Tumkur Mahanagara Palike shall also be liable to pay interest at a rate of 12% p.a. on the said sale
consideration of Rs.22,000/- per square meter from 24.06.2021 till the date of payment.
17. This writ petition is therefore disposed of.
18. In view of the disposal of the petition, all pending interlocutory applications, if any, stand disposed of.
