10-07-2025 Item No.207 Subrata Bhattacharyya AR(C) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side RVW No.4 of 2024 Sri Sourav Mondal -vs- State of West Bengal & Ors. with CAN No.4 of 2025 Mr. Subir Sanyal, sr. adv. Mr. Arijit Bakshi, adv. …for the petitioner Mr. Sandipan Banerjee, adv. Mr. Ankit Sureka, adv. …for the Corporation Mr. Ayan Banerjee, adv. Ms. Debasree Dhamali, adv. Ms. Riya Ghosh, adv. …for Bally Municipality 1. CAN No.4 of 2025 is for condonation of delay in filing the review application. 2. After hearing the parties and considering the case stated in the section 5 application, I condone the delay. CAN No.4 of 2025 is thus disposed of. 3. The petitioner seeks review of the order dated November 28, 2023 passed in WPA No.16407 of 2023. 4. I have heard the submission made on behalf of the petitioner and have perused the grounds for review. 5. None of the grounds mentioned in the review application can be taken as a good and valid ground for which a review is called for. 6. The writ petition stood disposed of by passing necessary direction upon the municipality to decide the issue of unauthorized construction raised by the writ petitioner/ review applicant. The police was directed to enquire into the antecedents of the petitioner as the court was not satisfied with the conduct of the petitioner in not taking steps to approach the court in proper time. 7. The submission of the municipality was noted that the petitioner had the habit of extracting money from private parties. 8. If the petitioner is aggrieved by the direction passed by the court, then he ought to have approached the appellate forum. No ground for review has been made out. 9. In view of the above, the application for review stands dismissed. 10. All parties are to act on the server copy of this order duly downloaded from the official website of this court. 11. Certified copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J] 2 3
