Chief Judicial Magistrate, Etah, vide his letter dated 9.9.2019, has informed this Court that appellant No.2- Shri Daulat has already passed away in the year 1987. In verification of his death, statements of Maharaj Singh S/o Daulat Ram and Bhagwan Singh S/o Daulat Ram have been recorded. Police report by S.I. Vijay Pal Singh of Police Station- Sirhpura, District- Kashganj has also been submitted. 2. Chief Judicial Magistrate, Etah, vide his letter dated 23.4.2022 has informed this Court that appellant No.1- Shri Raghuraj Singh has also passed away on 16.1.2020. Death Certificate issued by Government of U.P. has been annexed. A report of Raj Pal Singh, S.I. of Police Station- Sirhpura, District- Kashganj has also been annexed. 3. In view thereof, since both the appellants had already passed away, the instant appeal stands dismissed as having been abated. 4. Trial court record be sent back to the court concerned.
