1. Heard Mr. Ajay Kumrani, learned counsel for the petitioner. Also heard Mr. Malay Jain, learned Panel Lawyer for the respondent No.1 / State. 2. The petitioner has filed this petition praying for following relief:-
“1) Call for the entire records from the Courts below; 2) Set-aside/ quash FIR No. 100/2024 dated ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA Date: 2025.01.06 18:32:04 +0530
2 24.09.2024 registered against the petitioner; 3) Set-aside/ quash the entire Criminal Proceedings against the petitioner arising out of Criminal Case No 3767/2024 Pending before the Learned Court Below.(Annexure A/1); 4) Grant any other relief which this Hon'ble Court may deem fit and proper”
3. From perusal of the relief sought for in the present petition, it transpires that the same is a defective one as the counsel for the petitioner has not challenged the charge-sheet and order taking cognizance and has only drafted a vague and sketchy prayer. 4. In view of the same, learned counsel for the petitioner prays to withdraw the present petition, with liberty to file afresh with appropriate prayer and pleadings. 5. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh with appropriate prayer and pleadings, subject to depositing a sum of Rs.1,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today, and the same shall be transmitted to the Children Observation Home, Bilaspur. 6. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same, subject to deposit of the fine amount.
