The applicant has filed this third bail application under Section 483 of B.N.S.S. for grant of regular bail as he is in custody since 01.07.2022 in connection with Crime No. 341/2022 registered at police station Chakradhar Nagar, District Raigarh (CG) for the offence punishable under Sections 302, 120-B/34 IPC and Sections 25 and 27 of the Arms Act. 2. First bail application of the applicant was dismissed on merits vide order dated 17.11.2022 in MCRC No. 9271/2022 and the second bail application was dismissed vide order dated 09.10.2023 in MCRC No. 6858/2023. 3. Case of prosecution in brief is that on 25.06.2022, complaint was lodged by the complainant at police station Chakradhar Nagar alleging that his vehicle Trailer bearing No. CG13/L-4422 which was driven by Santosh Kumar Dubey, 2 (driver) on 23.06.2022 made a call that he is going to Mahapalli and after sometime, received another call that he is returning from Mahapalli. Thereafter at about 10.35 p.m. when the call was not received by him, he called another driver namely Sanjay Patel and Supervisor Nandkishore Gupta and inquired about the vehicle. On the next day, the supervisor called the complainant and informed that his vehicle is standing at Tilga Ghat and the driver was found dead in the cabin on the backside of the driver seat. Complainant lodged FIR at police station Chakradhar Nagar against unknown person. 4. Learned counsel for the applicant submits that the witnesses have not supported the case and the applicant is languishing in jail for a long period, therefore, the application may be allowed. 5. On the other hand, learned counsel for the State opposes the bail application. 6. I have heard learned counsel for the applicant and perused the record. 7. Be that as it may, considering the facts and circumstances of the case, nature of allegations, evidence collected on record and particularly considering that two applications of the applicant decided on merits, therefore, this Court does not find any good ground to allow this application. 8. Accordingly, bail application of applicant is hereby rejected. However, learned trial Court is directed to expedite the trial and conclude the same within a reasonable period of time.
