HON'BLE MR. JUSTICE BIPIN GUPTA Order 01/12/2025
[2025:RJ-JP:48660] (2 of 2) [CW-10594/2025]
1. The present writ petition has been filed challenging the order dated 10.03.2025, whereby not only the plaintiff’s evidence was closed, but the cross-examination of the plaintiff by the defendant was also closed on account of non-appearance of the plaintiff witness.
2. It is contended by learned counsel for the petitioner that an opportunity may be granted to him, to enable him to make himself available for cross-examination.
3. Heard.
4. This Court finds that the suit for simplicitor injunction was filed in the year 2009 and the issues in the suit were framed on
06.11.2009. After almost 16 years of framing of the issues, the plaintiff has not led any evidence.
5. This Court also finds that such conduct of the plaintiff disentitles him from any leniency being shown in his favour.
6. Considering the same, the present Civil Writ Petition is dismissed.
7. All pending application(s), if any, also stand disposed of.
