GP FOR REVENUE 2 HBKM,J W.P.No.12970 of 2020 The Court made the following Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents particularly the 4th respondent in attempting to dispossess the petitioner and in proposing to allot the house site pattas under the scheme of Navaratnalu- Pedalandariki Illu in the Grazing land (METHA BEEDU) situated in an extent of Ac.3-00 cents out of total extent of Ac.9.82 cents covered by Sy.No.376 of Immadicheruvu Revenue Village, Veligandla Mandal, Prakasam District. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that the 4th respondent identified an extent of Ac.3.00 cents in Sy.No.376 of Immadicheruvu Village for providing house sites to the beneficiaries as the land is fit for habitation having road access, electricity etc. The beneficiaries also agreed to reside therein. As per the F.L.R of the Immadicheruvu Village, the Sy.No.376 is classified as Grazing Poramboke land and it is vacant with rocks. The Government proposed to take the same for providing house sites in Sy.No.376. There is no encroachment in the proposed layout and there is no any kind of cultivation in the field. The claim of the petitioner to an extent of Ac.3.00 cents in Sy.No.376 of Immadicheruvu Village by way of an assignment is absolutely false. No assignment was given for the land in an extent of Ac.9.82 cents in Sy.No.376 to anyone at any point of time as per the 3 HBKM,J W.P.No.12970 of 2020 revenue records. The Government took steps for Jungle clearance in the above said poramboke land in an extent of Ac.3.00 cents. 4. In view of the interim orders of this Court dated 05.08.2020 the revenue authorities have not taken further steps to develop the subject extent of the land for house sites. The revenue authorities identified another suitable land for providing house sites to the beneficiaries. So far as the subject land of this writ petition is concerned, it is in the prohibited list published in the Annexure 22A-1(a) and the DKT patta issued to the petitioner is a fake one and it is created by the petitioner with an intention to grab the Government land. 5. In view of the above said facts and circumstances, no further orders are necessary in this writ petition and no relief can be given to the petitioner. However, the subject land in an extent of Ac.9.82 cents in Sy.No.376 of Immadicheruvu Revenue Village, Veligandla Mandal, Prakasam District shall be dealt with strictly in accordance with law, if so warranted for any public purpose. 6. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
