No. B/720/2018, dated 06.07.2019 in so far as it omits to take into account the basic value price of the acquired land admeasuring Ac.2.56 1/2 cents in Sy.Nos.51/1B2, 51/2A, 55/1A and 65/3B of Gudimellanka village, Malkipuram Mandal, East Godavari District (Rs.72.60 lakhs per acre) and takes into account the suggested 2 BKM,J W.P.No.21942 of 2020 amount of Rs.36.30 lakhs per acre as per the instructions of the 2nd respondent, ignoring the law contained in Section 26 of the Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act No.30 of 2013), is arbitrary and illegal and consequently direct the 1st respondent to pass a supplementary award superseding the award dated 06.07.2019 by awarding land acquisition compensation to the petitioner based upon the basic value price i.e. Rs.72.60 lakhs per acre (by subtracting the part payment which has already been received by the petitioner in terms of the impugned award at Rs.36.30 lakhs per acres for the acquired land) for the acquired land admeasuring Ac.2.56 1/2 cents in Sy.Nos.51/1B2, 51/2A, 55/1A and 65/3B of Gudimellanka village, Malkipuram Mandal, East Godavari District with interest at the rate of 18 percent per annum and make payment of the same to the petitioner forthwith and grant such other relief as it deems fit in the circumstances of the case.
