1. This is the second bail application filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail. The first bail application of the applicant has been dismissed on 23.09.2024, passed in MCRC No. 6452 of 2024 on merits.

Learned counsel for the applicant would submit that, after dismissal of the first bail application on 23.09.2024, the complainant has been examined as PW-6 before the learned trial Court and she has not identified the present applicant. The applicant is in jail since Digitally signed by VEDPRAKASH DEWANGAN
2 / 2 12.03.2024 and the trial of the case is not progressing considerably. Therefore, he filed the present second bail application.
3. On the other hand, learned counsel for the State opposes and has submitted that, out of 21 witnesses cited by the prosecution, total 13 witnesses have been examined till 14.11.2024 and the trial is in progress. Therefore, no case is made out by the applicant for grant of bail.
4. I have heard learned counsel for the parties and perused the material available on record.

Considering the submissions made by learned counsel for the parties, considering the fact that the first bail application of the applicant has been dismissed on merit on 23.09.2024, merely examining some of the witnesses does not amount to change in circumstances. Further, out of 21 witnesses, 13 witnesses have already been examined till 14.11.2024, I am not inclined to admit the second bail application.
