1. Heard Mr. Harshmander Rastogi, learned counsel for the petitioners and Mr. Saumitra Kesharwani, learned Panel Lawyer appearing for the State/respondents.
2. By filing this writ petition, the petitioner has prayed for following relief(s):-
“10.1 That, this Hon’ble Court may kindly be pleased
to
issue
a
writ/writs, direction/directions, order/orders directing the respondent authorities to frame promotion rules for Stenotypists enabling their promotion to the post of Stenographer Grade III who are working under Directorate of Health Services. 10.2 That, this Hon’ble Court may kindly be pleased
to
issue
a
writ/writs, direction/directions, order/orders directing the respondent authorities to decide the representations made by the petitioners (Annexure P/3 Colly.) in limited time frame. 10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.”

Learned counsel for the petitioner submits that the matter relates to grant of promotion to the petitioners, who joined their services as Stenotypists and in their service Rules, there are no promotional avenues, as such, they are forced to do the work for which, they are appointed till their retirement.
4. After hearing for some time, it appears that the petitioners ought to have filed some other petition challenging the service Rules, for which they have to approach before the competent Court.
5. At this juncture, learned counsel for the petitioners submits that he may be granted permission to withdraw this writ petition with liberty to file a duly constituted petition before the appropriate Court.
6. Prayer appears to be fair and reasonable.
7. In view of the above, instant writ petition is dismissed as withdrawn with aforesaid liberty granted in favour of the petitioners.
