Neutral Citation No. - 2025:AHC:61942-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 7830 of 2025 Petitioner :- Sumit Sethi And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Anita Gupta,Raj Kumar Vaishya Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Anil Kumar-X,J. 1. Heard learned counsel for the petitioners and learned A.G.A. for the State-respondents. 2. Present writ petition has been preferred for quashing the First Information Report dated 12.4.2025 registered as Case Crime no.0249/2025, under sections 112, 318 (4) BNS and section 3, 4 of Gambling Act, Section 3, 25, 30 of Arms Act, at Police Station Civil Lines, District Moradabad. 3. On the other hand, learned AGA on the instructions states that during investigation Sections 338, 366(3) and 342 B.N.S.-2023 are also added against the petitioners and the investigation is in progress. 4. Considering the factual situation, at this stage, we are not inclined to entertain the present writ petition for quashing the impugned FIR as cognizable offence is made out. 5. After substantial argument, once the court has declined to quash the impugned first information report, learned counsel for the petitioner states that the petitioner does not want to press the writ petition and the same may be dismissed as not pressed and leave may be accorded to invoke the remedy as available in law. 6. Accordingly, the writ petition is dismissed as not pressed leaving it open for the petitioner to apply before the competent court for anticipatory bail/bail as permissible under law and in accordance with law.
