The petitioner has filed the present petition under Article 226 of the Constitution of India with a prayer to direct the respondents to consider the case of the petitioner for grant of pre-mature release forthwith in the light of instructions/policy of the Punjab Government dated 08.07.1991 (Annexure P-1) HEMLATA 2025.05.13 05:45 I attest to the accuracy and integrity of this document CRWP-4162-2024 -2- and the law laid down by this Court in the case of “Jai Kishan Vs. State of Punjab” (Annexure P-2). 2. Learned counsel for the petitioner submits that at this stage, he shall be satisfied in case appropriate directions are issued to respondents No.1 and 2 to consider his case for grant of pre-mature release, in view of the law laid down by this Court in the matter of Criminal Writ Petition No.7180-2021 titled as “Jai Kishan Vs. State of Punjab and other”, which was upheld by the Hon’ble Supreme Court. 3. Learned State counsel has no serious objection to the prayer made by learned counsel for the petitioner, in this regard. 4. Consequently, the present petition is disposed of with a direction to respondents No.1 and 2 to consider the case of the petitioner within a period of four weeks from today, for grant of pre-mature release in the light of the instructions dated 08.07.1991 (Annexure P-1) as well as the law laid down by this Court in the matter of Criminal Writ Petition No.7180-2021 titled as “Jai Kishan Vs. State of Punjab and other”, which was upheld by the Hon’ble Supreme Court.
