...CONTEMNOR Petition under Sections 10 to 12 of Contempt of Courts Act 1971 praying that in the circumstances stated in the affidavit file herein the High Court may be pleased to pleased to punish the respondents by invoking the provisions of the sections 10 to 12 of the Contempt of Courts Act, 1971 by taking appropriate steps as per the contempt of Courts Act, 1971 in accordance with law for willful, wanton and deliberate disobedience of the Interim Order passed by this Honble Court on 10.02.2025 in W.P. No. 3351 of 2025 in the interest of justice and pass Counsel for the Petitioner:
1. D KISHORE KUMAR Counsel for the Contemnor:
1. G RAJU
The Court made the following:
::ORDER ::
Heard Sri D. Kishore Kumar, learned counsel for the petitioner and Sri Ram Manohar, representing Sri G. Raju, learned counsel for the respondent.
2. Petitioner filed W.P.No.3351 of 2025 to declare the action of respondents in not considering the petitioner’s candidature to the post of Senior Assistant, despite exonerating from charges in the departmental proceedings, as illegal and arbitrary.
3. The said writ petition was disposed of on 10.02.2025. The operative portion of the order reads as follows:
“Given the facts and circumstances of the case, the Writ Petition is
disposed of at the admission stage with the consent of learned counsel on either side directing the learned 3rd respondent to consider petitioner’s representation dated 07.10.2024 (Ex.P3) and pass appropriate orders, strictly as per the Rules within three (3) months from the date of receipt of the copy of this order. …”
4.
Learned counsel for the petitioner would submit that despite the order, dated 10.02.2025, the respondents failed to consider the petitioner’s case for promotion, and the authority issued a speaking order vide proceedings No.E/215/2025 dated 20.05.2025, wrongly interpreting the order, dated
10.02.2025.
5. Since a speaking order, dated 20.05.2025, was passed, following the
order, dated 10.02.2025, this Court does not find any violation of the order, dated 10.02.2025, in W.P.No.3351 of 2025.
6. Accordingly, this contempt case is closed. However, this order will not preclude the petitioner from challenging the proceedings No. E/215/2025
dated 20.05.2025, before the appropriate forum, if the petitioner is still aggrieved.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
