Order 21/11/2025
1. The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.494/2025 registered at Police Station Kotwali, District Baran for offence under Sections 191(2), 191(3), 190, 126(2), 121(1), 132, 109(1), 324(4) of BNS, 2023 and 3 of Prevention of Damage to the Public Property Act.
2. Since all these bail applications arise out of common FIR, hence, they are being decided by this common order.
3. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
[2025:RJ-JP:47085] (3 of 4) [CRLMB-12903/2025]
4.
Learned counsel for the petitioners submits that the petitioners have been falsely implicated in these cases. They further submit that there is no medical report by which it can be inferred that so called injuries are dangerous to life. They argued that some of the petitioners who were named in the FIR viz. Abdul Haq, Salman, Shoyab Ansar and Aashif Kureshi have been enlarged on bail by co-ordinate bench of this Court on
26.09.2025. They contended that names of the petitioners have not been mentioned in the FIR and no recovery has been made from them. They again submit that petitioners Mohammed Sabir and Mohammed Sharukh are in custody since 01.09.2025 and petitioners Mohammad Shahruk Urf Fatru, Mohammad Khijar since 08.09.2025 whereas Iftikar Ahmad Urf Bablu Bakse, Juned Ansari since 04.09.2025 and Mohammed Shahid @ Shahid Nai from 08.09.2025, Fajan @ Sonu Chuha and Mohammad Kalu @ Kalu Dj from 01.09.2025 and the trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and the bail applications of the petitioners may be allowed. 5. Learned Public Prosecutor has vehemently opposed the bail application. 6. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners
