FAMILY COURT APPEAL No.21 of 2024 JUDGMENT:(Per Hon’ble Sri Justice A. Hari Haranadha Sarma)
Appellant is the husband and respondent is the wife. Appellant/husband appeared personally before the Court and is identified by his advocate, Ms. Y.S.Sowmya and respondent/wife appeared virtually and is identified by her counsel, Ms. C.Indrani. 2. Both parties submitted that they have entered into a settlement and a joint memo is also filed incorporating the terms of settlement. In the joint memo, both parties and their respective counsels have signed. Marriage between the parties took place on 08.03.2015 at Hyderabad. 3. It is represented that both parties have been living separately for the past seven (07) years. There are no issues/offspring during the wedlock. All disputes between the parties have been settled and no litigations are pending. There are no other financial commitments inter se the parties. 4.
Referring to joint memo, the counsel on record and the parties have requested for converting the present proceedings which were filed under 13 (1)(ia) (ib) into proceedings for divorce on mutual consent in terms of Section 13B of the Hindu Marriage Act, 1955. 3
5. Upon considering the length of separate living of the parties, the settlement of all disputes, their request for conversion of proceedings to divorce on mutual consent from contested one and also waiver of cooling off period, if any, are all found convincing. Accordingly, their request is accepted. 6. For the reasons stated above, the marriage between the parties dated 08.03.2015 is dissolved by way of a decree of divorce on mutual consent. The identification cards i.e. Aadhar Cards of the respective parties duly attested by learned counsel for parties and the joint memo with terms of settlement deed by parties shall form part of the record. 7. Accordingly, the Family Court Appeal is dismissed. There shall be no order as to costs.
