The respondent has filed an affidavit dated 20.02.2025, stating his willingness to forgo 50% of the back wages, provided the petitioners-Management withdraws the amount. However, in paragraph No.4 of the affidavit, the respondent has imposed a condition seeking salary parity with his colleagues. - 3 - NC: 2025:KHC:7950 WP No. 3872 of 2012 3. Although the petitioners-Management has submitted a memo today, agreeing to the respondent’s claim and expressing their intent to withdraw the writ petition, they have brought to the Court’s attention the need for the withdrawal of the condition stated in paragraph No.4 of the affidavit. 4. At this stage, the petitioners-Management seeks permission to withdraw the writ petition without complying with the condition mentioned in paragraph No.4 of the affidavit. Prayer is allowed. Nevertheless, liberty is granted to the respondent to submit a representation to the petitioners-Management for consideration of his claim for salary parity with similarly placed colleagues.
