This bail application has been filed by the accused-petitioner under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, who has been arrested in connection with FIR No.648/2024 registered at Police Station Kotwali, District Jhalawar for the offence under Section 304(2) of B.N.S. 2. Learned counsel for the petitioner submits that the accused- petitioner is innocent and he has been falsely implicated in this case. He further submits that after completion of investigation charge-sheet has been filed. He also submits that the offence is triable by the Court of Magistrate. He also further submits that the accused-petitioner has been in custody since long and the conclusion of the trial will take long time, hence the petitioner may be enlarged on bail. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 5. Taking into consideration the overall facts and circumstances of the case, but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. Accordingly, this bail application is allowed and it is ordered that the accused-petitioner Shahnawaz @ Babu @ Kalu S/o Munna Bhai Ghonsi be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court for his appearance before the Court concerned on all subsequent dates of hearing and as and when called upon to do so.
