Heard learned counsel for the revisionist as well as learned A.G.A. for the State and perused the record. The preset criminal revision has been moved with prayer to set aside the impugned order dated 19.02.2024 passed by learned Principal Judge, Family Court, District Jaunpur in Case No.944 of 2017 (Rachana Vs. Raju Chauhan) under Section 126 of Cr.P.C., Police Station Gourabadshahpur, District Jaunpur and also against the order dated 15.10.2019 passed by learned Principal Judge, Family Court, Jaunpur in Case No.944 of 2017, under Section 125 Cr.P.C. (Rachana vs. Raju Chauhan), Police Station Line Bazar, District Jaunpur. It is submitted by learned counsel for the revisionist that an application u/s 125 Cr.P.C. was filed by the wife against the revisionist which was decided ex-parte by order dated
15.10.2019. An application u/s 126(2) Cr.P.C. was filed by the revisionist before the learned court concerned which was decided by order dated 19.02.2024 by which an application u/s 5 of Limitation Act and ex-parte order dated 15.10.2019 under Section 126(2) Cr.P.C. was allowed and he was directed to make 50% payment of amount of maintenance from the date of
order on application u/s 125 Cr.P.C. to the date of filing of application u/s 126(2) Cr.P.C. in 7 equal installments. Further submitted that since the revisionist is very poor person and not in a position to make payment of amount of maintenance, therefore, request to set it aside. Learned A.G.A. opposed the prayer as aforesaid. Considering the facts and circumstances of the case,
submissions made by learned counsel for the revisionist as well as learned A.G.A., perusal of record and the order passed by learned trial court dated 19.02.2024, there appears no any illegality or impropriety in the order but learned trial court has
passed the order for making payment of amount of maintenance in favour of the wife and already divided the amount in 7 equal installments. In this way, the impugned order does not require any interference by this Court but this revision being devoid of merit is liable to be dismissed. Accordingly, this criminal revision is dismissed.
